1. Introduction
These Terms of Service (the “Terms”) describe the rights and responsibilities that apply to your use of RemoteMarket (joinremotemarket.com) (the “Service”), owned and operated by RemoteMarket (“we”, “our” or “us”).
Please read the Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company, you represent that you have the authority to bind such entity to these Terms.
2. Eligibility
The Service is only available to individuals who are at least 18 years old (the age of majority in Ghana). By using the Service, you represent and warrant that you meet this eligibility requirement.
3. Your Account
If you create an account on RemoteMarket, you are responsible for maintaining the security of your account and password. You are fully responsible for all activities that occur under your account.
- Security: You must notify us immediately of any unauthorized uses of your account.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
4. Job Postings & Fees
A. Free Posting Period
Currently, RemoteMarket offers a “Launch Promotion” where Employers may post jobs for free. We reserve the right to change this pricing model at any time with prior notice.
B. Paid Services (Future)
In the event that you purchase paid services (e.g., Featured Listings), you agree to pay the applicable fees.
- Payment Processor: We use Paystack to securely process payments. We do not store your credit card or mobile money PINs.
- Refunds: Services are non-refundable unless we specifically decline to post your job. We do not provide refunds if you fail to hire a candidate or if you close the job early.
5. User Content & Conduct (Anti-Scam Policy)
You are entirely responsible for the content you post. By making content available, you represent that:
- No Scams: You will not post jobs that require applicants to pay money (e.g., for “training,” “equipment,” or “registration fees”). This is a zero-tolerance policy.
- No Protocol: You will not mislead applicants regarding the nature of the work.
- Rights: You own the content or have the right to use it.
RemoteMarket reserves the right to remove any job posting or ban any user immediately, without notice, if we suspect fraudulent activity or violation of these Terms.
6. Intellectual Property
All material available on the Service (design, logo, code, and “look and feel”) is the property of RemoteMarket and is protected by copyright laws. You may not duplicate, copy, or reuse any portion of the HTML/CSS, Javascript, or visual design elements without express written permission from us.
7. Disclaimer of Warranties
The Service is provided “as is”.
RemoteMarket acts as a venue to connect Employers and Job Seekers. We do not screen or censor the specific listings, but we do attempt to prevent scams. We make no guarantees regarding:
- The quality, safety, or legality of the jobs posted.
- The truth or accuracy of the listings.
- The ability of employers to offer job opportunities to candidates.
- The ability of candidates to fill job openings.
You acknowledge that you are responsible for conducting your own due diligence before accepting a job or hiring a candidate.
8. Limitation of Liability
In no event will RemoteMarket, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data.
9. Indemnification
You agree to indemnify and hold harmless RemoteMarket, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Service, including but not limited to your violation of this Agreement.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, specifically the Electronic Transactions Act, 2008 (Act 772).
Any dispute arising from these Terms shall be resolved through amicable negotiation. If negotiation fails, the dispute shall be referred to arbitration in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798) of Ghana. The place of arbitration shall be Accra, Ghana.
11. Changes
We reserve the right, at our sole discretion, to modify or replace any part of these Terms. It is your responsibility to check this agreement periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
